2. SCOPE OF APPLICATION

These Terms & Conditions of Sale and Use (the “Terms”) govern access to and use of the CARTE NOIRE website (the “Site”), as well as all online sales of products made through the Site.

They apply exclusively to consumers, as defined by French consumer law.

3. PRODUCTS

The products offered for sale are described and presented as accurately as possible. However, slight variations in color, texture, or appearance may occur due to screen settings or manufacturing characteristics.

Product availability depends on stock levels.
CARTE NOIRE reserves the right to modify or discontinue products at any time.

4. ORDERS

Placing an order constitutes an offer to purchase.

The sale is deemed final only once full payment has been received and an order confirmation email has been sent.

CARTE NOIRE reserves the right to refuse or cancel any order for legitimate reasons, including payment irregularities or suspected fraud.

Orders are intended for personal, non-commercial use only.

5. PRICES

Prices are displayed in euros (€) and include all applicable taxes (VAT).

Shipping costs and any additional charges are clearly indicated before order confirmation.

CARTE NOIRE reserves the right to change prices at any time. The price applicable is the one in effect at the time the order is placed.

6. PAYMENT

Accepted payment methods are displayed on the Site.

The customer guarantees that they are authorized to use the selected payment method.
Orders are payable in full at the time of purchase.

7. DELIVERY

Products are delivered to the address provided by the customer.

Delivery times are indicative and not guaranteed.
CARTE NOIRE shall not be held liable for delays caused by carriers or circumstances beyond its control.

Risk of loss or damage transfers to the customer upon receipt of the products.

8. RIGHT OF WITHDRAWAL

In accordance with Article L221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal, without justification.

To exercise this right, the customer must notify CARTE NOIRE by email or by using the withdrawal form below.

Returned products must be unused, undamaged, and returned in their original packaging.

Refunds will be issued within 14 days of receipt of the returned products, using the same payment method used for the purchase.

9. LEGAL WARRANTIES

Products benefit from the following legal warranties:

Legal Warranty of Conformity

(Articles L217-3 to L217-20 of the French Consumer Code)

The consumer has a period of two (2) years from delivery of the product to act.
Any lack of conformity appearing within twenty-four (24) months of delivery is presumed to have existed at the time of delivery, unless proven otherwise.

Warranty Against Hidden Defects

(Articles 1641 to 1649 of the French Civil Code)

The consumer may act within two (2) years from discovery of the defect.

These warranties apply independently of any commercial warranty.

10. INTELLECTUAL PROPERTY

All content available on the Site, including but not limited to texts, images, logos, trademarks, designs, videos, and graphics, is protected by intellectual property laws and remains the exclusive property of CARTE NOIRE or its licensors.

Any reproduction, representation, or use without prior written authorization is strictly prohibited.

11. PERSONAL DATA

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and applicable French data protection laws.

12. USER CONTENT

By submitting reviews, comments, or other content, the user grants CARTE NOIRE a non-exclusive, royalty-free, worldwide license to use such content for promotional and commercial purposes.

CARTE NOIRE reserves the right to remove any content deemed unlawful, inappropriate, or offensive.

13. LIABILITY

To the extent permitted by law, CARTE NOIRE shall not be held liable for indirect or consequential damages resulting from the use of the Site or the products sold.

Nothing in these Terms excludes or limits liability where such limitation is prohibited by law.

14. PROHIBITED USE

Any unlawful, fraudulent, abusive, or harmful use of the Site is strictly prohibited.

CARTE NOIRE reserves the right to suspend or terminate access to the Site in the event of a violation of these Terms.

In the event of a dispute, the consumer should first contact CARTE NOIRE to seek an amicable solution.

If no solution is reached, the consumer may refer the matter to a consumer mediation service free of charge:
